Domestic road transport
Overruling what's on the subject of terms and conditions on the general TransMission website: to all activities the (latest version of the) (FENEX) Dutch Forwarding Conditions apply (including the arbitration clause, in wich a.o. is stated that where the CMR is applicable, arbitrators shall apply the CMR).
International road transport
To all activities the (latest version of the) (FENEX) Dutch Forwarding Conditions apply (including the arbitration clause, in wich a.o. is stated that where the CMR is applicable, arbitrators shall apply the CMR).
Sea & air freight
To all activities the (latest version of the) (FENEX) Dutch Forwarding Conditions (including the arbitration clause) apply. With regard to transport, HST Sea & Airfreight B.V. never is contractual carrier but always freight forwarding agent.
Logistics
To all activities the Logistics Service Conditions (LSV) 2014 (including arbitration clause) apply. Pursuant to art. 2 paragraph 4 and 5 LSV, on Expedition work (carriage), customs and tax services apply the Dutch forwarding conditions, including arbitration clause if you opt for arbitration by the FENEX. Non-FENEX members have to pay a higher rate. Disputes which are not under the arbitration clause, arising out of or relating to (the) agreement(s) concluded between the parties, will be settled by the competent court in Rotterdam. Dutch law is applicable.
